General Terms and Conditions for the sale of goods to consumers residing in the EU via the internet platform www.andretan.eu
The operator and owner of this website is AndreTanFrankfurt, located at Borsigallee 26, 60399 Frankfurt am Main. All designations, brands, and logos on this website are the property of Andre Tan.
1.1 These General Terms and Conditions apply to all orders placed by consumers within the meaning of § 13 BGB (German Civil Code) residing or habitually staying in the Federal Republic of Germany (hereinafter "Customer") via the online shop www.andretan.eu (hereinafter "Online Shop").
1.2 A Consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor attributable to their independent professional activity.
In contrast, an Entrepreneur within the meaning of § 14 BGB is any natural or legal person or a partnership with legal capacity that acts in the exercise of its commercial or independent professional activity when concluding a legal transaction.
2.1 The Customer can order goods via the internet platform www.andretan.eu.
2.2 The presentation of goods in the Online Shop does not constitute a legally binding offer, but rather an invitation to place an order.
2.3 By placing an order, the Customer makes a binding offer to conclude a purchase contract.
2.4 The purchase contract is only concluded when Andre Tan Frankfurt accepts the order by sending a separate order confirmation via email.
2.5 After receiving the order, the Customer will receive an automatically generated confirmation of receipt via email. This does not yet constitute acceptance of the offer.
2.6 Andre Tan Frankfurt reserves the right to refuse orders, particularly if there is an unusually high number of returns or suspicion of fraud. In such cases, customer accounts may be deactivated.
Products can be placed in the shopping cart without obligation by clicking the "Add to cart" button. No reservation occurs at this stage.
The shopping cart can be viewed and modified at any time.
In the further course of the ordering process, the Customer enters their data and selects a payment method.
Before completing the order, the Customer must agree to these GTC and the Privacy Policy.
The ordering process can be canceled at any time before final submission.
For certain payment methods, the user may be redirected to external payment service providers.
The ordering process is complete as soon as the Customer is shown an order confirmation page with an order number. An additional confirmation will be sent via email.
4.1 All prices include the statutory VAT plus shipping costs. Shipping costs are €6.99; for orders with a value of €300 or more, shipping is free of charge.
4.2 The price stated at the time of the order is decisive. Errors and price changes are reserved.
4.3 Andre Tan Frankfurt reserves the right to change prices at any time.
4.4 Payment methods:

All payments are verified for fraud prevention. The seller reserves the right to exclude individual payment methods.
5.1 Delivery times:
Standard shipping: 2–3 business days
Express shipping: 1–2 business days
5.2 The goods remain the property of the seller until full payment has been made.
5.3 Partial deliveries are permitted insofar as they are reasonable for the Customer.
5.4 Should the delivery of the goods fail after three attempts for reasons for which the Customer is responsible, the seller may withdraw from the contract. Payments already made will be refunded.
6.1 The goods should be returned undamaged and in the original packaging whenever possible.
6.2 The Customer bears the direct costs of returning the goods.
6.3 Returns must be made within 14 days.
6.4 The Customer is only liable for any diminished value of the goods if this value loss is due to handling that was not necessary to check the condition, characteristics, and functionality of the goods.
6.5 Exclusion of the right of withdrawal: The right of withdrawal may expire for sealed goods if the seal was removed after delivery.
The statutory warranty regulations apply.
8.1 Claims for damages are excluded unless mandatory statutory provisions state otherwise. This does not apply to:
Damages resulting from injury to life, body, or health.
Damages based on intent or gross negligence.
Breach of essential contractual obligations.
8.2 In the event of a slightly negligent breach of essential contractual obligations, liability is limited to foreseeable damage typical for the contract.
8.3 The limitations of liability also apply in favor of legal representatives and vicarious agents.
8.4 Liability under the Product Liability Act remains unaffected.
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The European Commission provides a platform for online dispute resolution (OS).
If the "Stay logged in" function is activated, login data will be saved. This is not recommended on public or shared devices.
